Digital Image License
You are permitted to view and purchase digital images (designs) from this site. You are not permitted to copy, take or or duplicate any designs on this site without permission from NewSea Design. Any use or reproduction of NewSea Design’s designs without prior agreement or purchase is prohibited.
Agreement upon Check Out
By purchasing a design from NewSea Design you are agreeing to be bound by these Terms and Conditions of Use. Please read this agreement before you download or purchase any design.
Grant of License
NewSea Design grants to you use of purchased designs (commonly delivered via email attachment) subject to the Acceptable Use, Usage Limitations, and Unauthorised Usage. No rights are granted until payment is received in full.
Acceptable Use
After purchasing a design may be used for personal or commercial use. The purchased image file may be transferred via digital media and the following usage rights are granted:
- Digital and physical reproduction such as websites, ebooks, apps, software, books, magazines, posters and packaging.
- Using on clothing or merchandise for resale.
- Ability to print over any units / items / metres.
- Removal from the site once purchased.
- Supplied with fully editable Photoshop PSD or Vector AI or EPS file.
Usage Limitations
- No design may be sub-licensed or resold.
- You may not remove NewSea Design’s copyright information imbedded in the design file.
- Not permitted of using any NewSea Design design in pornographic, fraudulent, obscene, immoral, infringing, illegal, blasphemous or defamatory material or in breach of the privacy or any other rights of a third party or any law anywhere in the world.
Limited Warranty
The design has not been created to meet your individual requirements and it is your sole responsibility to satisfy yourself prior to entering into this agreement that the design will meet your requirements.
NewSea Design warrants that for a period of 90 days from the date of delivery of the design(s), as evidenced by your receipt, that the design, under normal use, will be free from defects. NewSea Design’s liability, and your remedy, under this warranty, will be NewSea Design’s option to replace the design, or to refund the purchase price and terminate this agreement.
Whilst NewSea Design makes all reasonable attempts to exclude viruses from the design, it cannot ensure such exclusion and no liability is accepted for viruses. Thus, you are recommended on receipt to thoroughly scan the design and insure yourself against any associated risk.
To the fullest extent permitted by law, NewSea Design shall not be liable to you for any costs, expenses, loss or damage (whether direct, indirect or consequential and whether economic or other) arising from your exercise of the rights granted to you under this agreement.
Termination of Agreement
This Agreement will automatically terminate upon failure by you, the licensee, to comply with any of its terms. If this happens, you hereby agree to destroy all copies and archives of the NewSea Design’s digital images, to cease using the images for any purpose, and to confirm to NewSea Design in writing that you have complied with these requirements.
NewSea Design reserves the right to discontinue the license of the design for any reason, and to elect to replace the image(s) with an alternative. Upon notice of any discontinuance of a license, you agree not to further use the discontinued design. NewSea Design reserves the right to commence legal proceedings if copyright infringement has ensued from unauthorised use of NewSea Design’s digital images.
